Within the past the year, both the United States Department of Labor and the Internal Revenue Service have announced their intent to “crack down on employers who misclassify employees as independent contractors.” Since the Fall of 2009, the IRS has confirmed that it will audit 6000 companies on a national basis, scrutinizing any alleged independent contractor agreements. Likewise, the Department of Labor in its proposed 2011 budget, announced a new emphasis on investigating employee misclassification with a particular focus on transportation, construction and healthcare industries.
